Terms of Service

Last updated

These terms govern your use of vest101. They are written to be read, so where a clause has a practical consequence for you, it says what that consequence is rather than only what the law permits.

1. Who you are contracting with

vest101 (“the Service”) is operated by Federico Pérez Fernández, registered at pending: registered address, pending: company/tax registration number (“we”, “us”). You can reach us at [email protected] or by telephone on pending: contact telephone number.

By creating an account you accept these terms. If you do not accept them, do not create an account.

2. What the Service is

vest101 is a portfolio tracking and research tool for individual investors. It reads your holdings and transaction history from brokers and other sources you connect, presents them in one place, and produces analysis, summaries and proposals about them using automated agents and a large language model.

It is a tool for your own use in managing your own investments. It is not offered as a service to third parties, and it is licensed to one person per account.

3. What the Service is not

This section is the most important one in the document. Read it even if you skip the rest.

  • We are not a broker, a dealer, a custodian or a payment institution. We never hold your money or your securities.
  • We are not an investment adviser and we do not provide investment, tax or legal advice. Nothing the Service produces — including advisor answers, agent proposals, recommendations, scores and reports — is a personal recommendation, and none of it takes your financial circumstances, objectives or risk tolerance into account.
  • We never execute a transaction. Broker connections are read-only. Any decision to buy, sell or hold is made by you, and any order is placed by you at your own broker.
  • We do not guarantee the accuracy, completeness or timeliness of any figure, price, forecast or analysis. Market and broker data is obtained from third parties and may be delayed, incomplete or wrong.
  • Past performance does not predict future results. The value of investments can fall as well as rise, and you may get back less than you invested.

4. Automated analysis and AI output

The advisor and the research agents are built on a large language model. Language models produce fluent text that can be confidently wrong, and this one is no exception. Treat everything they produce as a starting point for your own research, never as a conclusion.

Agent output is presented as proposals that require your explicit approval before they change anything in your account. We do not operate an autonomous mode, and approving a proposal does not place a trade.

5. Your account

  • You must be at least 18 years old and legally able to enter into a contract.
  • You are responsible for keeping your password secure and for everything done through your account.
  • One account is for one person. Do not share credentials.
  • You must give a working email address; we use it for verification, password resets and service notices you cannot opt out of.
  • Tell us promptly at the address in section 1 if you believe your account has been accessed by someone else.

6. Broker and third-party connections

When you connect a broker you provide API credentials that you obtained yourself from that broker. You are responsible for scoping those credentials to read-only access at the broker, and for complying with the broker’s own terms.

We store those credentials encrypted and use them only to read your positions, transactions and dividend history. You may disconnect a source at any time, and you may revoke the credential at the broker at any time without telling us first.

7. Subscription, price and billing

  • The Service is available on one paid plan at €19 per month, billed in advance.
  • Payments are processed by Stripe. Your card details are entered on Stripe’s systems and are never received or stored by us.
  • The subscription renews automatically each month until cancelled.
  • We may change the price. If we do, we will give you notice by email before the change takes effect, and the new price will apply from your next renewal — never retroactively to a period you have already paid for.
  • Prices are inclusive of applicable VAT where we are required to charge it; Stripe determines this from the billing country you provide.

8. Cancellation and refunds

You can cancel at any time from your account. Cancelling stops the next renewal; access to paid features continues until the end of the period you have already paid for, and then stops. We do not pro-rate or refund a partial month.

If you are a consumer in the EU you have a statutory right to withdraw from a distance contract within 14 days. By starting to use the Service immediately you ask us to begin performance during that period; you may still withdraw, and we will refund the amount paid less a proportion reflecting the service already supplied. pending: confirm this withdrawal clause with a lawyer for your jurisdiction

Cancelling does not delete your data. See the Privacy Policy for retention and for how to request deletion.

9. Acceptable use

Do not: use the Service unlawfully; attempt to access another user’s data; probe, scan or attack the infrastructure; scrape or resell the Service or its output; reverse engineer it; use it to build a competing product; or use automated means to place load on it beyond normal individual use.

Security research is welcome, but report findings privately first — see the Security page.

10. Availability

We aim to keep the Service available but we do not promise a service level. It may be unavailable for maintenance, because a third party we depend on is unavailable, or because something broke. We are not liable for losses arising from unavailability, and you should not rely on the Service being reachable at a particular moment for a time-sensitive decision.

11. Liability

Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, and for a consumer’s statutory rights.

Subject to that, and to the maximum extent permitted by law: the Service is provided as-is; we are not liable for investment losses, lost profits, lost opportunity or indirect or consequential loss; and our total liability to you in any twelve-month period is limited to the amount you paid us in that period.

12. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate an account that breaches these terms, that is being used to attack or abuse the system, or where we are required to by law. Where it is reasonable to do so, we will tell you why and give you a chance to put it right first.

13. Changes to these terms

We may update these terms. For material changes we will notify you by email at least 30 days before they take effect, and continuing to use the Service after that date means you accept them. If you do not, cancel before the date and the old terms apply for the rest of your paid period.

14. Governing law

These terms are governed by Spanish law, and the courts of Madrid, Spain have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, nor of your right to bring proceedings before the courts of that country.
